Sturm Ski School General Terms and Conditions of Business

1. Content of the website

Sturm Skischule & Handels KG (hereinafter the “Author”) shall accept no liability for the timeliness, accuracy, completeness or quality of the information provided. Liability claims against the author that relate to material or non-material damages, which were caused as a result of using or not using the information provided or by using incorrect and incomplete information, shall be excluded unless the author is shown to have acted with intent or gross negligence.
All offers are non-binding and without obligation. The author expressly reserves the right to amend, supplement, delete or temporarily or permanently suspend publication of parts of the pages or the entire website.

Courses can be extended at the specified extension rate from day 3.

If a group reduces in size to fewer than 4 participants, we reserve the right to combine groups or to reduce the number of class hours.

Teachers may be changed several times due to the flexible organisation of courses.

We accept no liability for accidents that may occur during or prior to the ski lesson. Course participants are responsible for obtaining accident and liability insurance.

Fees will only be refunded due to injury or illness on presentation of a doctor’s certificate. Only days not attended (difference) will be refunded.

Courses that are cancelled due to weather conditions (force majeure) will not be refunded.

Private courses will take place in any weather.

Course tickets are non-transferable. Any unattended course days will lapse.

Courses for beginners start on Sundays and Mondays. Advanced participants can begin courses on any day, insofar as their ability matches the various standards of the groups.

On Saturdays no group lessons are generally held.

No group courses are held on 1 January of any year.

Payment:
You can pay by credit card (Mastercard and Visa) or EC Maestro card. Information is entered in the Webshop via Payyo. This is our SSL secure connection so you can pay securely and conveniently.

All services and supplies of Sturm Skischule & Handels KG based on online orders over the Internet or other online services are subject to these General Terms and Conditions of Business.

2. References and links

Direct or indirect references to external Websites (“links”) that lie outside of the area of responsibility of the author shall only result in obligations of liability, if the author is aware of the contents and if it was technically possible and reasonable for the author to prohibit said use in the event of illegal content.

The author hereby expressly states that at the time of adding the link, no illegal content was discernible on the linked site. The author has no influence whatsoever on the current and future design, content or authorship of the linked/connected websites. The author therefore expressly distances itself from the content of all linked/connected websites that have been changed since the link was added. This statement applies to all links and references placed on its own website and to third-party entries made in the guestbooks, discussion forums and mailing lists set up by the author. The provider of the site linked to, and not the provider of the site on which the links reference the respective publication, shall be exclusively liable for any illegal, incorrect or incomplete content and in particular damages resulting from the use or non-use of such information.

3. Copyright and trademark law

The author diligently strives to observe all copyrights of the graphics, recorded documents, video sequences and texts used in all of his publications, to use graphics, recorded documents, video sequences and texts he has created or to make use of royalty-free images, recorded documents, video sequences and texts.
All brand names and trademarks mentioned within the website and protected by third parties shall be subject to the unrestricted provisions of the respective current trademark laws and the rights of ownership of the respective registered owner. If mention is made of the above, it should not therefore be inferred that brand names are not protected by third party rights!

The copyright for published objects created by the author shall remain with the author of the pages. The aforementioned images, recorded documents, video sequences and texts may not be reproduced or used in other electronic or printed publications without the express approval of the author.

4. Data protection

If the Website includes the option to enter personal or commercial information (e-mail addresses, names, addresses), this data may be disclosed by the user on a voluntary basis. Insofar as the author appoints third parties to render the services offered, the author is entitled to disclose the customer data to third parties if necessary for the purpose of the contract.

The customer expressly states that the data it provides may be saved and processed. Sturm Skischule & Handels KEG warrants the confidentiality of this data and shall not sell, lease or make it available to third parties if not necessary for the purpose of the contract.

5. Legal effect of this disclaimer

This disclaimer is considered an integral part of the Website on which a link to this page is provided. If sections or individual terms of this statement do not, no longer or do not completely confirm to the valid legal situation, the content and validity of the remainder of this document remains unaffected.

6. Booking and reservation of ski and snowboard courses

Online reservation requests for ski and snowboard courses shall come into force on payment of the full course fee. We shall hold your reservation until close of business on the date of reservation. After this period, the reservation shall lapse. Should you not take up the reservation for any reason, we shall reimburse the payment for the reservation up to 7 days prior to the start of the reservation. If the reservation is cancelled within the last 6 days prior to the start of the course, we reserve the right to retain up to 10% of the course cost as compensation.

The ski course fee does not include use of the lifts. Sturm Skischule & Handels KG cannot provide any compensation for lessons that cannot be held due to failure of the cable car and lift.

7. Hire and reservation of ski and snowboard equipment

We shall hold your reservation until close of business on the day of reservation. After this period, the reservation shall lapse.

Every hirer shall be liable for properly returning the equipment up to the sales value of the hired products. For Economy class at least EUR 250,-, for Premium class at least EUR 350,-, for Superior class at least EUR 450,-. The hirer shall have the option to exclude liability for breakage (third party or personal fault), damage, theft or interchanging of the hired items by paying the protection fee at the start of the hire period. This shall be 10% of the hire price and cannot be reclaimed, even if no damage has occurred. In case of theft or loss a police report is mandatory.

Return of the rental material on the last day of rent until 6pm. No refunds for equipment not used during rental period - regardless of any reasons. Earlier returned equipment will be refunded for days not begun.

The hirer shall be entitled to demand security in the form of a piece of ID (passport, ID card, driving licence) or a deposit. Presentation of a means of security shall not be considered as the purchase price of the equipment.

8. Place of jurisdiction, place of performance and choice of law

The place of performance shall be the central seat of Sturm Skischule & Handels KG.

The court having jurisdiction at the central seat of Sturm Skischule & Handels KG shall be competent to rule on any disputes . Austrian law shall apply. The language of contract is German.

9. Newsletter

If you make a booking or purchase with us, send us an enquiry, request information or sales literature, we process your personal data in accordance with Article  6 Section 1 b and f.

If you would like to receive the newsletter offered on the website, we need an email address for you as well as information that allows us to verify that you are the owner of the email address given and consent to receive the newsletter (double opt-in).

You can withdraw consent at any time very easily through the unsubscribe function in the newsletter sent to you. The legal basis for the processing is point (a) of Article 6(1) GDPR. We use the data exclusively for sending newsletters.

Further data is not collected other than on an expressly voluntary basis, e.g. to optimise the contents to suit your interests. This data is stored by us and used exclusively to send the required information and to personalise the newsletter. In addition, we carry out link tracking to analyse and continually improve the newsletter content.

Our newsletters contain tracking pixels. A tracking pixel is a miniature graphic which is embedded in emails that are sent in HTML format to enable log file recording and log file analysis. In this way, statistical analyses can be produced and assessments of the success or failure of online marketing campaigns can be carried out. With the help of embedded tracking pixels, we can recognise whether and when an email was opened by you and which links you clicked on in the email.

The personal data collected via the tracking pixels contained in the newsletters is stored and analysed by us, as the controller, to optimise the sending of the newsletter and to better adapt the contents of future newsletters to your interests. This personal data is not passed on to third parties. You are entitled at any time to withdraw the special declaration of consent regarding this via the double opt-out process. Once consent is withdrawn, we erase this personal data. If you unsubscribe from the newsletter, we interpret this automatically as a withdrawal of consent.

To produce the newsletter, we use the service “NumBirds” from Sports and Tourism Digital Services GmbH, 6020 Innsbruck, Brixner Straße 3/3. To safeguard the confidentiality of your personal data, we have come to an agreement with the company for processing.

10. Cancellation Policy for Online Bookings

With our „Worry free - cancellation package”:

• Cancellation without stating reasons up to 24 hours prior to the start of the course No handling fees

Without insurance:

• Up to 30 days prior the start of the lesson 20% cancellation fee (written confirmation from the doctor for example required)

• Up to 10 days prior the start of the lesson 50% cancellation fee (written confirmation from the doctor for example required)

• Less than 10 days prior the start of the lesson 100% cancellation fee! All deliveries and services of the Ski School made by online order via the internet and all other online services are subject to these Terms & Conditions.
